Nομοσχέδιο στις ΗΠΑ αποσκοπεί στη νομιμοποίηση του ψευδοκράτους της κατεχόμενης Κύπρου

Ενώ το -χρηματοδοτούμενο από Ελλάδα και Κύπρο- Ελληνοαμερικανικό Ινστιτούτο (AHI) υποστηρίζει το Νομοσχέδιο Αρ. 2597, που παρουσίασαν οι ''φιλέλληνες'' βουλευτές Μπιλιράκης και Μαλόνι, πιο προσεκτική εξέταση του, αποκαλύπτει πως νομιμοποιεί τον "οργανισμό δίχως νομική οντότητα" της "Τουρκικής Δημοκρατίας της Βόρειας Κύπρου" σαν "όργανο" της Τουρκίας, αντί να τον καταδικάζει ως ψευδοκράτος. Μάλιστα, τα ΜΜΕ στην Ελλάδα παρουσίασαν ως ''επιτυχία'' το Νομοσχέδιο, φιλοξενώντας και ''βαρύγδουπες'' δηλώσεις του θεωρούμενου ως φιλέλληνα βουλευτή Γκας Μπιλιράκη.

Νομοσχέδιο στις ΗΠΑ είναι προτεινόμενη νομοθεσία που έχει εγκριθεί από επιτροπή του Κογκρέσου. Με βάση  παλαιότερο νόμο για αποζημίωση Αμερικανών με περιουσίες σε κομμουνιστικές χώρες, το νομοσχέδιο εξισώνει την Τουρκική διοικητική μαριονέτα των κατεχόμενων με κυβέρνηση.  Έτσι, περιορίζει τη δύναμη των Αμερικανικών δικαστηρίων να αποφασίζουν υπέρ των δικαιωμάτων των Ελληνοκυπρίων, όπως συνέβη στην περίπτωση των ψηφιδωτών της Κανακαριάς (Αυτοκέφαλη Εκκλησία της Κύπρου εναντίον Γκόλντμπεργκ), κηρύσσοντας το ψευδοκράτος "οντότητα αγνώστου ταυτότητας" όταν δοκίμασε να σφετεριστεί τις ιστορικές εικόνες. Προς το παρών, καθεστώτα που δεν αναγνωρίζονται ως κυβερνήσεις δεν μπορούν να προσφύγουν σε δικαστήρια των ΗΠΑ, αν και μπορεί να μηνυθούν μια και δεν έχουν ασυλία.  Ωστόσο, εάν το νομοσχέδιο ψηφιστεί σαν νόμος, το ψευδοκράτος θα αποκτήσει ασυλία.

Εάν το Κογκρέσο θα μπορούσε να διατάξει τη κυβέρνηση Ομπάμα να διαπραγματευτεί με παράνομες οντότητες, οι διεθνείς σχέσεις θα διεξάγονταν με κακοποιούς.  Αντί να αναδεικνύει τα στοιχεία οργανωμένου εγκλήματος του καθεστώτος, όταν καταλαμβάνει και κλέβει περιουσίες, το νομοσχέδιο ντύνει το ψευδοκράτους με ασυλία που υπονομεύει το νόμο, δεδικασμένα και ψηφίσματα των Ηνωμένων Εθνών (541 και 550) που καταδίκασαν το ψευδοκράτος.  Δίνει εντολές δε στη κυβέρνηση των ΗΠΑ να διαπραγματευτεί άμεσα και να διακανονίσει αποζημιώσεις για περιουσίες Ελληνοκυπρίων με το κατακτητή και τούς εποίκους από τη Τουρκία.

Ακόμα χειρότερα, το νομοσχέδιο προτείνει "αποζημίωση" με μια διάταξη "προτεραιότητας" που επιδιώκει διευθετήσεις για "25.000 δολάρια" ή λιγότερο.  Δεν είναι σαφές κατά πόσο τα $25.000 δίνονται σε άτομα ή για ακίνητα. Με άλλα λόγια, το νομοσχέδιο θεωρεί πως περίπου $675 ανά έτος είναι ικανοποιητικά για 37 χρόνια κατοχής! Οι επιπτώσεις αυτού του νομοσχεδίου, εσκεμμένα ή όχι, είναι τόσο επικίνδυνες όσο και η Επιτροπή Ακίνητης Ιδιοκτησίας (IPC), όπου Ελληνοκύπριοι έχουν μπλοκαριστεί για χρόνια στη δυστυχία, χωρίς αποζημίωση, λαμβάνοντας τελικά αινιγματικές ανταμοιβές. Τέλος, με βάση άλλο δεδικασμένο του Ανώτατου Δικαστηρίου των ΗΠΑ (Ντέημς και Μούρ εναντίον Ρήγκαν), ίσως το νομοσχέδιο να απαγορεύσει και να αναστείλει τις μηνύσεις εναντίον του ψευδοκράτους στις ΗΠΑ.

Παράδοξα, ενώ η μήνυση των Ελληνοκυπρίων προσφύγων στις ΗΠΑ είχε προκαλέσει "συναγερμό" για δήθεν νομιμοποίηση του ψευδοκράτους, το νομοσχέδιο που ανοίγει τις διπλωματικές σχέσεις του ψευδοκράτους με τις ΗΠΑ δεν έχει ούτε καν λάβει την προσοχή της κυβέρνηση της Κύπρου.

Συμπερασματικά, το νομοσχέδιο δεν προστατεύει τις ιδιότητες και τα δικαιώματα των Ελληνοκυπρίων. Στη περίπτωση που το νομοσχέδιο γίνει νόμος, μπορεί να ανατραπεί με δίκη. Το νομοσχέδιο θεωρείται συνταγματικά "για φούντο" δεδομένου ότι εξισώνει την μαριονέτα του ψευδοκράτους με κυβέρνηση. Το νομοσχέδιο θα έπρεπε να καταδικάζει το ψευδοκράτος, να κατονομάζει την Τουρκία ως υπόλογη, να παρείχε σε Ελληνοκυπρίους δίκαιη αποζημίωση για 37 χρόνια κατοχής, να προστάτευε το δικαίωμα τους να επιστρέψουν στην πατρογονική τους γη και τα δικαιώματα τους να προσφύγουν σε δικαστήρια των ΗΠΑ ατομικά και συλλογικά και να συμπεριλάμβανε ένα χρονικό όριο στο οποίο οι αποζημιώσεις θα έπρεπε να καταβληθούν.  Αλλιώς, Αμερικανοκύπριοι με περιουσία στα κατεχόμενα θα αντιμετωπίσουν την ίδια άδικη και παράνομη συμπεριφορά μερικοί απερίσκεπτοι Ελληνοκύπριοι αντιμετώπισαν όταν έπεσαν στην παγίδα του IPC, του τουρκικό Δούρειου Ίππου που κλέβει τις περιουσίες Ελληνοκυπρίων, ένα αναγκαίο βήμα πριν την οριστική διχοτόμηση της Κύπρου.

U.S. Proposed Legislation Mistakenly Seeks to Legitimize the Pseudo-State in Occupied Cyprus in Violation of Court Decisions, Foreign Policy and U.N. Resolutions

While the American Hellenic Institute supports Congressional Bill No. 2597, its closer examination reveals it legitimizes the "unincorporated association" of the "Turkish Republic of Northern Cyprus" as an "agent" of Turkey instead of condemning it as a pseudo-state.

A Bill is proposed legislation first approved by a congressional committee.  Based on a law that sought to compensate Americans for their properties in communist countries, the Bill equates the puppet Turkish administration of the occupied territories with a government.  It guts the power of U.S. Courts to vindicate the rights of Greek Cypriots as it happened in the case of the Mosaics of Kanakaria (Autocephalous Church of Cyprus v. Goldberg) declaring the pseudo-state an "unrecognized party" when it claimed ownership over the artifacts.  Presently, unrecognized regimes cannot resort to US courts, although they can be sued and have no immunity.  However, if the Bill becomes law, the pseudo-state may become immune to lawsuits.

If Congress could mandate the Obama administration to negotiate with illegal entities, foreign relations would be conducted with thugs.  Rather than exposing the mafia element of the regime when it occupies and steals properties, the Bill cloaks the pseudo-state with the legitimacy of a sovereign undermining law, legal precedents and United Nation Resolutions 541 and 550 that condemned the pseudo-state.  It even mandates the US Government to negotiate and settle property claims of Greek Cypriots directly with the occupiers and the settlers from Turkey.

Even worse, the Bill proposes a "settlement" through a "priority" provision that seeks to settle claims for "$25,000" or less.  It is not clear whether $25,000 pertains to individuals or properties.  In other words, the Bill considers approximately $675 per year for 37 years of occupation as adequate compensation!  The effects of this Bill, intentional or not, are as dangerous as the Immovable Property Commission (IPC), where Greek Cypriots have been bottled for years in misery without compensation, eventually receiving trivial amounts of compensation.  Finally, based on a U.S. Supreme Court precedent (Dames & Moore v. Regan), potentially the Bill can prohibit and suspend U.S. court litigation against the pseudo-state.

Astonishingly, while the U.S. class action of Greek Cypriot refugees had caused "alarm" for its falsely reported legitimization of the pseudo-state, this Bill that legislates diplomatic relations between the pseudo-state and the U.S. has yet to raise an eyebrow from the government of Cyprus.

In conclusion, the Bill does not protect the properties and the rights of Greek Cypriots.  Should this bill become law, it can and will be overturned in court.  The Bill is constitutionally overboard as it equates the puppet pseudo-state with a government.  The Bill should have condemned the pseudo-state, holding Turkey accountable, giving Greek Cypriots fair compensation for 37 years of occupation, protecting their right to return to their ancestral lands, protecting their rights to resort to U.S courts individually and collectively and placing a time limit on when claims must be paid.  Otherwise, American Cypriots with property in the occupied territories are facing the same unjust and egregious treatment some ill-advised Greek Cypriots faced, when they fell in the trap of the IPC, a Turkish Trojan Horse that steals property from Greek Cypriots, a necessary step in the final dividing Cyprus.

AHI Corrects Record for Erroneous Statements Regarding Property Bill
WASHINGTON, DC — The American Hellenic Institute (AHI) has issued the following statement in response to an erroneous public statement issued by Tsimpedes Law Firm on August 4, 2011, in reference to H.R.2597, the American Owned Property in Occupied Cyprus Claims Act, which is backed by AHI.
The Tsimpedes Law Firm’s statement, led by its principal, Athan Tsimpedes, Esq., erroneously states the bill “equates the puppet Turkish administration of the occupied territories with a government,” implying that the bill somehow recognizes the legitimacy of the “Turkish Republic of Northern Cyprus.”  The firm’s statement also erroneously states, “It [the bill] even mandates the US Government to negotiate and settle property claims of Greek Cypriots directly with the occupiers and the settlers from Turkey.”
The fact is that the bill sets forth two distinct and separate processes by which U.S. nationals can seek the fair rental value of their property in Turkish occupied Cyprus.
The bill authorizes and urges the president of the United States to open a claims program under which a claims fund would be established.  U.S. nationals or their descendants who continuously owned occupied property under the laws of the Republic of Cyprus since July 20, 1974 would claim against the fund for the fair rental value and loss of use of the property.  The Foreign Claims Settlement Commission would administer the fund.  Contrary to Tsimpedes’ claim, the fund would be established through government to government negotiations between only the United States and the Republic of Turkey.  The size and source of funds for the claims fund would be the primary subject of those negotiations. 
The bill also mandates that the U.S. district courts hear lawsuits asserted by U.S. nationals who own property in Turkish occupied Cyprus against a private person who occupies that property for the rental value and loss of use of the property.  The U.S. national would have to be able to obtain personal jurisdiction over that private person in the United States which means that the private person must also be present in the U.S. as presence is defined under the U.S. law.  The U.S. district court would determine whether the U.S. national has valid title and the amount of the rental value only according to the laws of the Republic of Cyprus.
As a result of the Tsimpedes Law Firm’s erroneous statement, AHI has received numerous electronic communications from the community and media organizations inquiring if the bill means that U.S citizens relinquish their property rights.  Neither process would in any way either theoretically or practically require any U.S. national to relinquish title to property in Turkish occupied Cyprus.
“The public statement issued by the Tsimpedes Law Firm is erroneous, and it has led to confusion in the community, which is unfortunate,” said AHI President Nick Larigakis.  “We firmly stand by this legislation.  We commend Congressman Frank Pallone for introducing the bill, and we appreciate the bipartisan support of the bill by the Hellenic Caucus Co-Chairs, Congressman Gus Bilirakis and Congresswoman Carolyn Maloney.  We urge the community to seek the support of their U.S. representatives for this bill.”
